Independent investigation and collection of evidence. Briefly explaining what this process is, we can say that the collection of evidence is the activity of the parties to criminal proceedings, enshrined in the legislation of Ukraine, namely the victims, representatives, in respect of which the case is taking place, during which the search is carried out, the discovery of sources of real events, the seizure , receiving and fixing information.
There are two types of evidence:
- For the prosecution (part 2 of article 93 of the Code of Criminal Procedure).
- For the defense, the victim, a legal entity (part 3 of article 93 of the Code of Criminal Procedure).
For the prosecution, evidence is collected by:
- investigative and covert investigative actions
- receipt, seizure of documents, information, expert conclusions, acts, inspections
- international cooperation
- other
Usually, the most common investigative actions are interrogation, search, inspection. Each investigative action is carried out in the manner prescribed by law.
It also helps the investigation to carry out covert investigative actions (for example, hidden video filming, inspection of property, location, etc.).
Evidence can be actual data (for example, a document or a hidden camera at a crime scene with a video that can be seized and attached to the materials).
There are steps in calculating the veracity of factual evidence:
- Establishing the veracity of sources.
- Establishing the correct method of extracting information.
- Establishing the veracity, taking into account other materials of the case (for example, when a conscientious person testifies and this information does not agree with the information of the accused and the expert’s opinion).
